The natural follow-up question from a prospective client is: Why? This answer requires a more in-depth explanation.

An experienced personal injury attorney helps you recover the maximum amount from the insurance company because the insurance adjusters who control the money know who the experienced personal injury attorneys are. When they work with an unrepresented claimant or hire an attorney who does not regularly practice personal injury, the adjusters know that there is minimal risk of being sued and the injury case going to a trial. I sue people all the time. If you are a non-lawyer trying to handle your own case, it’s very likely that you don’t regularly sue people – and the insurance companies know this. The question I get asked most often, right after how much is my claim worth, is "how long will it take for my claim to settle?" The typical attorney response I’ll give you is, it depends. But seriously, it depends on various factors; the most crucial piece is that we cannot even begin negotiating until you, as the injured person, are finished treating

  • We only get one bite at the apple, so we cannot come back later for more.
  • We need to know you won’t incur future medical bills.
  • We need to know what the subrogation claim will be from your health insurer (this is how much you’ll have to pay back to your health insurer)

We all know how expensive it can be to hire an attorney. As an attorney who frequently litigates cases, I will be the first to acknowledge that attorney fees can (and do!) mount rather quickly, especially in contested matters. This fact is no secret, as the general public is pretty well aware of how expensive attorneys can be. Most require an upfront retainer and then provide the client with regular statements with a bill that reflects the attorney’s time tracked by the tenth of the hour.
